We provide desktop property valuation reports for self-managed superannuation funds, capital gains tax purposes, deceased estates, family law matters, and other compliance needs (the “Services”).

By using the Website or ordering a report, you agree to these Terms & Conditions (the “Terms”). If you do not agree, please do not use the Website or place an order.

We may update these Terms from time to time. Changes take effect from the date of publication on this page.

2. Services

We provide independent desktop property valuation reports prepared by a certified property valuer using comparable sales data, market analysis, and other relevant information available at the time of preparation.

Our reports are designed to satisfy SMSF audit requirements, ATO compliance obligations, and other regulatory purposes as described on the Website.

3. Ordering and Payment

3.1. To order a report, you must complete the order form on the Website and provide accurate information including the property address, fund name, valuation date, and any other details requested.

3.2. You warrant that all information you provide is accurate and complete. Inaccurate information may affect the validity of the report and we accept no liability for errors arising from incorrect information supplied by you.

3.3. Payment is processed through Stripe. By placing an order, you agree to Stripe’s terms of service. You will receive a confirmation and tax invoice once payment is received.

3.4. Prices are as listed on the Website at the time of order and include GST where applicable.

4. Delivery

Reports are delivered electronically by email in PDF format. Standard turnaround times are listed on the Website but may vary depending on the complexity of the valuation, the availability of comparable sales data, or order volume. We will notify you if a delay is expected.

5. Refunds and Cancellations

5.1. Once a report has been delivered, no refund is available, as the service has been fully performed.

5.2. If you cancel an order before the report has been prepared, we will issue a full refund less any payment processing fees.

5.3. If we are unable to complete a report (for example, due to insufficient comparable sales data for the property or location), we will notify you and offer either a full refund or an alternative approach.

5.4. Nothing in this clause limits your rights under the Australian Consumer Law.

6. Scope and Limitations of Reports

6.1. Our reports are desktop valuations based on publicly available data and proprietary databases. They do not involve a physical inspection of the property unless separately agreed.

6.2. Reports are prepared for the purpose stated in the order and should not be relied upon for any other purpose, including mortgage lending, insurance, or litigation, unless we have expressly agreed in writing.

6.3. A valuation is an estimate of market value at a specific point in time based on the information available. Actual sale prices may differ from the assessed value. We do not guarantee that a property will sell at or near the assessed value.

6.4. Our reports are prepared for the exclusive use of the client named in the report and, where applicable, their accountant, financial adviser, or SMSF auditor. We accept no liability to any third party who relies on a report without our prior written consent.

6.5. We exercise professional care and skill in preparing our reports, however we do not accept liability for any loss arising from circumstances beyond our reasonable control, including but not limited to undisclosed property defects, zoning changes, or market movements after the valuation date.

7. Intellectual Property

All content on the Website, including text, graphics, logos, and report templates, is owned by or licensed to SMSF Valuation Reports Pty Ltd and is protected by Australian copyright law.

You may not reproduce, distribute, or republish any content from the Website or from any report without our prior written permission, except for reasonable use of a report for the purpose for which it was ordered.

8. Privacy

We collect and handle personal information in accordance with our Privacy Policy, which is available on the Website. By using the Website and placing an order, you consent to the collection and use of your information as described in that policy.

9. Limitation of Liability

9.1. To the maximum extent permitted by law, our total liability in connection with the Services or these Terms is limited to the fee paid for the relevant report.

9.2. We are not liable for any indirect, consequential, or incidental loss, including loss of profit, business opportunity, or goodwill, however arising.

9.3. Nothing in these Terms excludes or limits any guarantees, rights, or remedies that cannot be excluded under the Australian Consumer Law.

10. Indemnity

You agree to indemnify us against any loss, damage, claim, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Website or Services, or any inaccurate information you provide to us.

11. Dispute Resolution

11.1. If a dispute arises in connection with these Terms, you must first notify us in writing, setting out the nature of the dispute and the outcome you are seeking.

11.2. The parties must attempt to resolve the dispute by negotiation within 14 days of the notice. If the dispute is not resolved within that period, either party may refer the matter to mediation administered by the Resolution Institute, with the mediation to be held in Adelaide, South Australia.

11.3. Each party will bear its own costs of the mediation. The mediator’s fees and venue costs will be shared equally.

11.4. Neither party may commence court proceedings in relation to the dispute unless the above process has been followed, except where urgent interlocutory relief is sought.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of South Australia. The parties submit to the exclusive jurisdiction of the courts of South Australia and any courts entitled to hear appeals from those courts.

13. Severability

If any part of these Terms is found to be void, invalid, or unenforceable, that part will be severed and the remaining Terms will continue in full force.
